Non-Immigrant Visas - TN
Usually the quickest and easiest way to bring aboard a Canadian or Mexican is by way of a “TN,” which reflects that the individual is employed in a professional occupation. There are specific professional occupations in which an individual may seek to be qualified for the TN. Generally (with a few minor exceptions) the minimum threshold to be qualified for a specific profession is the possession of a Bachelor's degree in the field. For example, an individual would readily qualify in the professional occupation of “Engineer” if the position requires at least a Bachelor's degree in Engineering and if the individual has such a degree.
Provided that the individual is qualified, a TN can be obtained in person at the border (either at a land border or a pre-flight inspection facility). As part of the application, the individual will usually be asked to submit proof of Canadian citizenship, a Bachelor’s degree, a resume, and an employment letter describing the individual's position and his or her qualifications. A decision will be made on the spot and the entire process usually does not take more than 1 hour. It is advisable to have an attorney assist with the drafting of the employment letter, which is usually no more than a page or two in length. The TN is usually valid for up to 3 years at a time but can be renewed for an indefinite period. TN applications can be made in-person at the border or a pre-flight inspection facility, or through the mail at the appropriate USCIS Service Center.
