01/03/13 The U.S. Citizenship and Immigration Services has published its final rule in the Federal Register allowing provisional I-601A waivers for certain immediate relatives of U.S. citizens who are subject subject to the 10-year bar for unlawful presence upon their departure from the United States. This rule enables qualifying individuals to obtain approval of their provisional I-601A waiver applications before departing the United States to attend consular interviews in their home countries. Previously, these individuals could not file I-601 waivers until after they had departed the United States. Individuals who entered the United States without inspection who are unable to adjust status in the United States are a large class of individuals who will tremendously benefit from this rule. In order to obtain approval of their provisional I-601A waivers, these individuals will have to demonstrate that the denial of their waiver applications will cause extreme hardship to a U.S. citizen spouse and/or child. This new procedure will drastically reduce the amount of time that these individuals must be separated from their families before obtaining their immigrant visas overseas. The process will go into effect on March 4, 2013. USCIS has provided interim guidance on the new process until further information becomes available.
